Prices and General Terms

House prices (€ per night) are fully inclusive covering the consumption of electricity, the supply of hot and cold water to the kitchens and bathrooms, the use of bedlinen and bathroom towels (no beach towels) as well as the use of the pool. House prices not subject to VAT. With the obvious exception of food and beverages, there are not hidden extras to pay.

Terms & Conditions (Houses)

(1) Definition
Nubita Eivissa S.L. (VAT number B-57530941) is the lessor of the residential building C/Estret, 4, Puig Delfin, 07830 Sant Josep, Ibiza, Spain and acts on behalf and in representation of the owner. The tenancy agreement is concluded between Nubita Eivissa S.L. and the tenant. The tenant does not pay any commission.

(2) Prices
The prices refer to the respective house and are not subject to VAT. Standard occupancy is four (4) persons per house. Children over three (3) years are considered a full person.

(3) Alterations of the leased property
It is prohibited to change the interior or exterior of the houses. Nothing must be removed from the houses or the property.

(4) Additional costs
Additional costs such as electricity, gas and water are included in the rent.

(5) Term of lease
The minimum term of lease is seven (7) nights. The houses will be available for occupation from 2:00 p.m. on the applicable day of arrival and must be vacated by 11:00 a.m. on the applicable day of departure. The end of the lease obliges the tenant to return the keys of the rented house to Nubita Eivissa S.L. Tenants are respectfully asked to look after the property and its contents and to leave it in the same good condition in which it was found.

(6) Reservation
To reserve the property, Nubita Eivissa S.L. will send the prospective tenant a lease contract and the Terms & Conditions by fax, mail or e-mail. As from this moment, Nubita Eivissa S.L. gives the prospective tenant an option for a confirmed reservation of ten (10) calendar days..

Short term reservations (reservations 15 days or less before the applicable day of arrival): Nubita Eivissa S.L. will grant the prospective tenant an option for the confirmed reservation until 2:00 p.m. the next day.

(7) Confirmed reservation
To make a confirmed reservation of the property, the prospective tenant must submit the following documents / fulfil the following conditions:

1. the signed rental contract
2. the signed terms & conditions
3. a copy of his or her ID
4. remittance of 40% of the full lease amount to the business account of Nubita Eivissa S.L.

If the confirmed reservation is made 15 calendar days or less before the beginning of the lease, the prospective tenant is obliged to transfer the entire rental fee.

The remittance is considered concluded if the amount to be transferred has been booked on the business account of Nubita Eivissa S.L., or if Nubita Eivissa S.L. has received the remittance slip issued by the bank.

The fulfilment of these four points means that the reservation is binding for both sides. The tenant will receive a confirmation from Nubita Eivissa S.L. by fax, mail or e-mail.

(8) Full Payment
The outstanding amount is to be transferred to the business account of Nubita Eivissa S.L. at the latest 30 calendar days prior to occupation. If the remaining amount is not transferred in due time, Nubita Eivissa S.L. may cancel the reservation and keep the advance payment.

Short term reservations (reservations 15 days or less before the applicable day of arrival): The remaining amount must be paid in cash upon arrival. If the remaining amount is not paid in due time, CASAYA has the right to cancel the reservation and keep the advance payment.

(9) Refundable damage deposit
DA separate refundable damage deposit is required and must be handed over in cash upon arrival. In case of any damage in or around the rented property the tenant is obliged to immediately inform Nubita Eivissa S.L. If the damage was caused by the tenant, reparation costs must be refunded by the tenant immediately. If the tenant does not pay for the damage, he or she will not be allowed to stay any longer in the house.
Nubita Eivissa S.L. will refund the entire amount of the deposit at the end of the rental period if the tenant has fulfilled all obligations according to the rental contract.

(10) Noise reduction
The tenant is obliged to keep down any volume of music and other noise between 10 p.m. and 10 a.m. so that neighbours will not be disturbed.

(11) Cancellation
The tenant may cancel the lease agreement in writing, even after the binding reservation has been confirmed. In this case, the tenant has to pay a cancellation fee, which amounts to the following percentages of the entire lease price:

up to 45 calendar days prior to occupation 10%
up to 30 calendar days prior to occupation 40%
up to 15 calendar days prior to occupation 60%
up to 6 calendar days prior to occupation 80%
5 calendar days and less prior to occupation 100%

Short term reservations (reservations two weeks or less before the applicable day of arrival): The tenant may cancel the lease agreement in writing, even after the reservation has become binding. In this case, Nubita Eivissa S.L. retains the advance payment (40% of the total rental fee) as cancellation fee.

(12) Rebooking
A change of the term of lease on request of the tenant is only possible if the property still is available. In this case, a fee of € 50 will be charged.

Short term reservations (reservations two weeks or less before beginning of renting): Changes of the term of lease are not possible.

(13) Tenant’s liability
The tenant must treat the rented property with care. She/he is obliged to inform Nubita Eivissa S.L. without delay about any damages, even if they were not caused by the tenant. The tenant is responsible for all damages caused by himself/herself or by his or her visitors. Animals are not permitted.

(14) Nonperformance
If the tenant sets up a claim against Nubita Eivissa S.L. because of incompliance or bad compliance, Nubita Eivissa will react accordingly and examine the facts of the case.

(15) Place of jurisdiction
In case of a lawsuit in connection with this contract the parties waive their usual place of jurisdiction and explicitly submit themselves to the jurisdiction of Ibiza.
